        Article 3 public resource trading platform refers to a system that implements unified systems and standards, has an open and shared electronic service system for public resource trading and a standardized and transparent operation mechanism, and provides comprehensive services for public resource trading for market subjects, the public, administrative supervision and management departments, etc. The Sichuan provincial public resource trading platform referred to in these Rules refers to the national public resource trading platform (Sichuan Province) as the hub, and the provincial and municipal public resource trading platform promoted by the people's government at or above the municipal level divided into districts as the main body, connecting all levels and all kinds of public resource electronic trading systems, public resource trading electronic supervision systems and other systems, A comprehensive service system for public resource transactions that realizes the exchange and sharing of public resource transaction information and data.
 
        The public resource trading platform established by the county-level government is the sub platform of the municipal public resource trading platform. Other market entities are encouraged to voluntarily include professional trading platforms that are built in accordance with the law and meet the standards set by the Sichuan Provincial People's Government (hereinafter referred to as the provincial government) into the management of Sichuan public resources trading platforms. The public resource trading projects mentioned in these rules refer to the "Sichuan public resource trading catalogue" formulated by the provincial government and the projects within the scope of the public resource trading catalogue legally expanded by local departments (units) on the basis of this catalogue. Transactions involving national security, state secrets, rescue and disaster relief, public security and other special projects shall be implemented in accordance with relevant regulations.
 
        Article 4 the public resource trading platform operation service institutions mentioned in these rules refer to the provincial and municipal public resource trading service centers promoted by the people's governments at or above the municipal level divided into districts and the service institutions of professional trading platforms included in the management of Sichuan public resource trading platforms. Article 5 Sichuan public resources trading platform should be based on the public service function positioning, adhere to the electronic development direction, and follow the operation and service principles of openness and transparency, resource sharing, efficiency and convenience, law-abiding and integrity. Article 6 the leading department for the integration and sharing of public resource trading platforms designated by the people's governments at or above the municipal level divided into districts is responsible for implementing the decisions and arrangements of the CPC Central Committee, the State Council, the provincial Party committee and the provincial government on the integration and sharing of public resource trading platforms, studying and solving major problems in the work related to public resource trading within their respective administrative regions, and proposing major policies and measures for the reform of the field of public resource trading.
 
        The departments of development and reform, economy and informatization, finance, natural resources, housing and urban-rural construction, transportation, water conservancy, agriculture and rural areas, health and health, state-owned assets supervision and administration, forestry and grassland, medical security, intellectual property rights, data management and other departments at or above the county level (hereinafter referred to as administrative supervision and administration departments) shall, in accordance with the division of responsibilities, supervise and manage the trading activities of public resources in this field and industry in accordance with the law. The public resource trading service center established by the people's government at or above the municipal level divided into districts is responsible for the construction, operation, service and management of the public resource trading platform in its administrative region, establishing and improving the norms of entry trading and the network information security system, and promoting the standardization and standardization of the public resource trading platform in its administrative region.
 
        Article 7 people's governments at or above the municipal level divided into districts shall incorporate public resource trading platforms into the construction of basic public service system, strengthen the investment in place facilities and human security of public resource trading platforms in their respective regions, and ensure that the needs of public resource trading activities are met. Without the approval of the provincial government, local departments (units) shall not build new public resource trading platforms. Article 8 public resource trading platforms at all levels shall, in accordance with the unified standards for venue facilities, information construction, safety, service quality, supervision and evaluation stipulated by the state and provincial governments, make full use of existing venue resources, provide necessary trading venues and facilities, scientifically divide functional areas, and set up service windows to meet the needs of business handling of trading activities.
 
        Article 9 the national public resources trading platform (Sichuan Province) is the provincial public resources trading electronic service system and information release media. The provincial public resources trading service center is authorized by the provincial government to construct, operate and manage.         The provincial and municipal public resource trading platforms promoted by the people's governments at or above the municipal level divided into districts shall establish an electronic service system for public resource trading in accordance with the national unified technical standards and data specifications, and open up the public resource electronic trading system built by various entities according to law and the electronic supervision system of relevant government departments. Article 10 the public resources electronic trading system is independently constructed by public resources trading platforms at all levels and relevant entities according to law and regulations, providing full process online trading services for public resources trading projects, and pushing project trading information to the national public resources trading platform (Sichuan Province) in accordance with unified technical standards and data specifications. Article 11 the electronic supervision system for public resource transactions shall be promoted and established by the people's governments at or above the municipal level divided into districts to provide supervision channels for the supervision subjects. The transactions of public resource transactions shall be fully recorded, online monitored and supervised in real time.
 
        Article 12 the relevant departments at the provincial and municipal levels shall promote the two-way connection between the public resource transaction project approval system, supervision system, market subject credit system, and various transaction systems and the public resource transaction platform at the same level, so as to realize the exchange and sharing of public resource transaction data and information resources such as project approval, administrative supervision and management, market subject credit, expert resources, transaction process, transaction results, etc. Provincial and municipal public resource trading platforms and their connected electronic trading systems should push data to the electronic supervision system in real time to strengthen the dynamic supervision and early warning of trading activities. Article 13 If a professional trading platform established by a market entity according to law is voluntarily included in the public resource trading platform, it shall comply with the unified national standards for venue facilities, service standards, technical standards and data specifications, pass the testing and certification of a nationally recognized certification body, and realize data exchange and sharing with the national public resource trading platform (Sichuan Province).
 
        Article 14 a public resource trading platform shall comply with laws and regulations, unified trading rules in various fields formulated by relevant departments of the State Council, and relevant management regulations promulgated by the people's government at the higher level and at the same level. The provincial industry competent department shall formulate unified trading rules in various fields by industry, and clarify the trading rules such as entry platform level, trading process, qualification requirements, evaluation methods, contract signing, performance acceptance and information disclosure. Article 15 public resource trading projects in the public resource trading catalogue shall be included in the corresponding level of public resource trading platforms for trading in accordance with laws and regulations and the unified deployment of the state. Public resource trading projects that have not been included in the public resource trading catalogue shall voluntarily enter the public resource trading platform at the same level for trading, and shall not be rejected by the public resource trading platform if they comply with the provisions of Article 16 of these rules.
 
        Article 16 the entry transaction of public resource trading projects shall meet the legal trading conditions and obtain legal procedures. Under any of the following circumstances, it is not allowed to enter the platform for trading. Article 17 Where a public resource trading project needs bid evaluation and evaluation according to law, experts for bid evaluation and evaluation shall be determined according to law. If qualified, expert resources should be used across regions by means of remote bid evaluation. Article 18 the administrative supervision and administration department shall promote the public resource trading projects that enter the public resource trading platform to carry out transactions by electronic means, and promote convenient trading methods such as online bidding, "don't meet" bid opening (bidding), remote bid evaluation, online supervision, etc.
 
        Electronic transactions of public resources shall comply with national laws and regulations and administrative supervision and management requirements. The "no meeting" bid opening (bidding) rules and remote bid evaluation rules shall be formulated by the relevant provincial administrative supervision and administration departments in conjunction with the provincial public resources trading service center. The network environment for bid opening and evaluation shall be constructed and maintained by the provincial and municipal public resources trading service center in accordance with the relevant supervision and administration rules. Article 19 the public resources trading platform shall disclose the transaction information of public resources trading projects (including transaction announcement, qualification examination result information, transaction process information, bid evaluation (examination) result information, transaction result information, contract signing information, performance information, etc.) in a timely manner according to law.
 
        Except for state secrets, trade secrets, personal privacy and other information that should be kept confidential according to law. (1) The transaction information of public resource trading projects is uniformly released on the national public resource trading platform (Sichuan Province) and its municipal (prefecture) platforms. If the relevant administrative supervision and administration departments of the state designate another media for the information release of public resource trading projects, the relevant information shall be released simultaneously on the designated media with the national public resource trading platform (Sichuan Province) and its municipal (prefecture) platforms. (3) The information release subject shall be responsible for the authenticity, accuracy, integrity and legitimacy of the information it provides, and ensure that the information content of the same transaction project released by it in different media is consistent.
 
        The national public resources trading platform (Sichuan Province) and its municipal (prefecture) platforms are responsible for the timeliness and integrity of their information release, and release it within 1 working day from the receipt of the information. (1) Admission registration. When a public resource trading project enters the public resource trading platform, it should log in to the national public resource trading platform (Sichuan Province) or its city (prefecture) platform, register the basic information of the project, and generate the project code. For offline entry registration, the operation service institution of the public resource trading platform shall complete the acceptance within 1 working day from the date of receiving the information of the public resource trading project. If the public resource trading project does not meet the trading conditions for entering the platform or the submitted materials are incomplete, the platform operation service institution shall not accept it and inform the reasons at one time.
 
        (3) Organize transactions. It includes: issuing transaction announcements and transaction documents, receiving competitors (including bidders, suppliers, bidders, etc., the same below) to participate in competition, organizing bid opening or bidding, establishing bid evaluation committees according to law for projects requiring bid evaluation, and carrying out bid evaluation activities. (4) Confirm the transaction. Including: publishing the publicity of bid evaluation results, confirming the transaction results, publishing the publicity of transaction results, and Issuing the letter of acceptance or transaction confirmation. (5) Sign and publicize the contract. The main terms of the contract shall be consistent with the transaction documents and the transaction commitment documents, and no other agreement deviating from the substantive content of the transaction documents and the transaction commitment documents shall be signed. Article 21 If any of the following circumstances occurs to a public resource trading project during the trading period of the public resource trading platform, the operation service institution of the public resource trading platform shall suspend the trading in accordance with the relevant provisions and procedures.
 
        (2) The operation service institution of the public resource trading platform and the administrative supervision and management department find that they fail to perform the corresponding procedures according to law or there are violations of laws and regulations in the public resource trading activities, which may affect the trading results or cause serious losses;. (3) The transaction cannot be carried out due to force majeure, or abnormal circumstances such as the failure of the public resource trading system during the transaction affect the transaction;. After the reason for suspension is eliminated, the operation service institution of the public resources trading platform shall timely arrange the project implementation subject to resume trading activities; If the transaction conditions are no longer met, the transaction shall be terminated. Article 22 in the process of data collection, summary, analysis, transmission, storage, disclosure and use, the public resource trading platform shall strengthen security management, and shall not disclose important and sensitive data for commercial purposes without authorization.
 
        The management of confidential data shall be carried out in accordance with relevant regulations. The security and data security management of the public resources electronic trading system, the public resources electronic trading supervision system, and the public resources electronic trading service system shall implement the "who constructs the operation and maintenance, who is responsible for the management". Article 23 the operation service institution of the public resource trading platform shall archive the electronic documents, paper materials and audio and video generated by the public resource trading platform, and the storage period of the archives shall not be less than the legal time limit. Article 24 the operation service institution of the public resource trading platform shall provide services such as transaction witness, place and facility guarantee, information release, expert extraction, file management, bid security agency, etc. for public resource trading activities, and explore comprehensive financial services such as electronic guarantee and financing services.
 
        The service content, service process, work specifications, charging standards and supervision channels of the public resource trading platform shall be determined in accordance with legal requirements, and shall be made public through the provincial and municipal public resource trading electronic service system and trading venues. In principle, the operation service institution of the public resource trading platform shall not charge fees for providing public services. If it is really necessary to charge fees, it shall be implemented in accordance with the relevant national and provincial regulations, and shall not be for the purpose of profit. Article 25 the operation service institution of the public resource trading platform shall establish and improve the operation, management and service system of the public resource trading platform, implement safety protection technical measures, and ensure the smooth operation of the public resource trading platform.
 
        We will implement standardized and standardized management, continue to optimize platform services, and implement online processing measures such as online booking, "one form application" and "one network access". If it is really necessary to handle on-site, we will implement centralized windows, simplified processes, and time limited processing. Public resource trading platforms at all levels shall realize online announcement and publicity, online access to and submission of documents, online bid opening (bidding), electronic auxiliary bid evaluation, electronic collection of archives, and promote online handling of services such as digital certificates, place appointments, expert extraction, witness certificates, etc. Article 26 the provincial public resources trading service center shall implement dynamic management of the main body information database of the provincial public resources trading market, provide the service of "registration in one place, universal in the whole province", and promote the realization of "registration in one place, universal in the whole country".
 
        If a market subject has registered in the public resources electronic trading system or the electronic system established by relevant departments according to law, and realizes information sharing through the public resources electronic trading service system, the relevant administrative supervision departments and the public resources trading platform operation service institutions shall not force it to repeat registration, filing and verification. Article 27 the administrative supervision and administration department shall, in accordance with the division of responsibilities, strengthen the supervision of the whole process of public resource trading activities, and investigate and deal with violations of laws and regulations according to law. We will improve the coordination mechanism between administrative supervision and management departments and departments (units) such as supervision, public security, justice, auditing, taxation, and public resources trading service centers.
 
        Audit departments should strengthen the audit and supervision of public resource trading activities in accordance with the law. Administrative supervision and management departments and their staff shall abide by the provisions on the management of public resource trading platforms when exercising supervision. Without legal authorization, no unit or individual shall interfere with and affect the normal public resource trading activities carried out on the public resource trading platform according to law. Article 28 the administrative supervision and administration department shall establish an inspection system of "two random and one open" to strengthen the supervision of the main bodies of the public resource trading market. In the process of performing its duties, the administrative supervision and management department has the right to consult and copy the documents, materials and data related to public resource trading activities according to law. The operation service organization of the public resource trading platform and relevant departments shall cooperate and be responsible for the authenticity, accuracy and integrity of the materials provided.
